Paedophile records himself raping three young girls.

A high-risk Timaru paedophile who recorded himself raping three young girls has been sentenced to 18 years in jail.

Phillip Brendon Page, 36, was sentenced in the High Court at Timaru today on 26 child sex charges by Justice Rachel Dunningham, who imposed a minimum non-parole period of 10 years.

The 26 charges Page had admitted included five of sexual violation by rape, six of sexual violation by unlawful sexual connection, 11 of doing an indecent act on a child, two of doing an indecent act on a young person, and two of doing an indecent act with intent to insult or offend.

When he pleaded guilty in the High Court at Christchurch last year, the Crown said the offending involved four girls and two boys and took place over several years.

Godfrey (aka Geoffrey) Ball, 78, of Masterton, a retired school bus driver who was facing 12 representative sex charges against boys aged 7 to 16, was found dead in his Waterhouse St home on Thursday by neighbours whom the Times-Age understands were supporting him. The alleged offending took place in Wellington between 1964 and 1985 and related to sexual assault and sodomy.

An 18-year-old man has admitted indecently assaulting a 12-year-old girl, but denies sexually grooming her in an online chatroom.

In Masterton District Court this morning, Kayne Storm McIntyre pleaded guilty to indecently assaulting the girl after allegedly driving from Rotorua to a Wairarapa home and picking her up.

Caregiver convicted of abusing children in his care.

Taite Hemi Kupa, 57, has been found guilty in the High Court at Whangarei on 21 of 23 charges relating to sexual and physical abuse of vulnerable children in his care.

Kupa had admitted kicking children and pinching their ears to humiliate and discipline them. Others were raped and sodomised, the court heard.

Johann Daubeck, 19, has been found guilty of rape of a child under 12. Daubeck was sentenced to seven years in prison with a minimum period of imprisonment of four years.

His girlfriend, who filmed the rape, was sentenced to two years intensive supervision and 200 hours community work for six charges, including uploading the images to the internet.

Wayne William Smith, 55, was last month found guilty on three charges of sexual violation and six of engaging in sexual conduct with a young person. He was acquitted on four other sexual conduct charges. Full article here.

As is common with sexual predators, he attempts but fails to shift the blame away from himself and onto the victim. His narcissim probably lead him to believe the jury would be as gullible as his unfortunate young victim.

A man who had sex with an 11-year-old girl to make his ex-girlfriend jealous has been jailed for three years.

18-year-old Cameron Anthony Waudby, pleaded guilty to a charge of sexual connection with a child under the age of 12, was sentenced to three years in jail by judge Brian Callaghan.

His lawyer Richard Bodle, doing his best to downplay the gravity of the crime, described Waudby’s actions as “inappropriate” and said  Waudby was “very immature” and did not understand how wrong his behaviour was. “He wasn’t thinking at the time that it was that bad.”

Cameron Anthony Waudby, who was 18 at the time of the offending last year, earlier admitted in the Greymouth District Court a charge of sexual connection with a child under the age of 12.

Lawyer Richard Bodle told the court that Waudby was “very immature” and did not understand how wrong his behaviour was.

“He grew up in a violent family, which paints a picture of a young man who has come from a difficult background, where he did not learn the best way to behave sexually.”

Mr Bodle said Waudby was remorseful and accepted that what he did was entirely inappropriate. “He wasn’t thinking at the time that it was that bad.”

Mr Bodle also stressed that the court’s role was “rehabilitative rather than punitive”. Judge Brian Callaghan said he had concerns that Waudby had a sexual preference for younger females.

The court was told Waudby had sex with the girl twice in June last year. Judge Callaghan said the victim would probably be haunted by what happened for the rest of her life.

“Because of what has happened she is over-clothing herself, not wearing skirts and over-eating.”

The judge said a worrying factor was that he believed Waudby would offend again: “The worry for me is that I think if you are not treated you will be a clear risk to young female children.”

Judge Callaghan stressed that Waudby would need to have appropriate treatment while in prison, without which “there is a high risk of you reoffending”.

Dion Selwyn Tau, who was sentenced last August to preventive detention (an open-ended sentence), has had his appeal dismissed because he remains at a high risk of reoffending. Tau was found guilty on 14 charges, including sexual violation, indecent assault and threatening to kill. At the time, Judge Graham Lang said Tau inflicted horrific abuse on his victims, then aged 13, 15 and 16-years-old.

Sex offender’s appeal rejected.

A violent sex offender who attacked young girls has had his appeal against preventive detention dismissed because he remains at a high risk of reoffending. Dion Selwyn Tau was sentenced to preventive detention in August for three sexual assaults that happened in Auckland between June 2007 and July 2009.

Tau claimed his sentence was excessive and he genuinely wanted psychological treatment. A preventive detention sentence means that even after eight years Tau will not be released from prison unless he demonstrates he has been rehabilitated.

In a decision released today, the Court of Appeal rejected Tau’s appeal. Three separate psychological reports found Tau failed to take responsibility for his crimes and posed a high risk of serious assault unless he received ongoing treatment.

Tau was at a high risk of reoffending and his “sexual deviance, anti-sociality and psychopathic traits” were especially concerning. Justice Lynton Stevens said the combination of these factors would make his treatment difficult.

The judges agreed with the original High Court decision, taking into account the seriousness of the offending and age of the victims. Tau was found guilty on 14 charges, including sexual violation, indecent assault and threatening to kill, last year.

At the time, Judge Graham Lang said Tau inflicted horrific abuse on his victims, then aged 13, 15 and 16-years-old. He said Tau was a predator who had “wrought havoc” on the girls and their families and sent “shockwaves” through the community.

In the first attack Tau talked a 13-year-old girl into getting into his car and showing him the way to a local rugby club. Once in the car, Tau hit the girl around the head and sexually assaulted her – telling her that if she didn’t do as he asked she would end up dead in a bush.

In November 2008 Tau, dressed as a truancy officer and, carrying a clipboard, got out of his car and approached a 15-year-old girl dressed in her school uniform. He asked her why she was not at school and said he needed to take her home to check her story.

Once at her doorstep, Tau became aggressive and violent, and forced his way into her family home. The girl tried to fight back but Tau grabbed her by the hair, punched her several times and threw her down the stairs.

He then forced her into a cupboard before sexually assaulting her. As he left, Tau stole items from the house, including the girl’s school bag. In the 2009 attack, Tau stopped a 16-year-old girl walking home at midday. He forced her into his car before finding a quiet street to stop and sexually assault her.

Judge Lang said the indefinite prison term was the only option for Tau given the aggravating factors which included premeditation, the level of violence involved and the vulnerability of the victims.

Child murderer/pedophile denied parole.

Luke Frederick Sibley, who in 1997 strangled and suffocated three-year-old Brittany Crothall while she slept to try to cover up the fact that he had been sexually abusing her, has been denied parole until he completes a sex offenders’ programme.

A man jailed in the 1990s for the murder of a toddler will not be freed until he takes part in a sex offenders’ programme. The Parole board’s decision, released to APNZ today, found it was “essential” that Luke Frederick Sibley take part in the programme.

He was sentenced in the High Court at Christchurch to life imprisonment with a 13-year non-parole period for the murder, and for attacking the toddler’s mother with a hammer, in 1997. The board, led by Judge David Carruthers, found that although Sibley was not charged with sex offences, it had been “part of his murder.”

Judge Carruthers said a recommendation had been received from a psychologist who suggested that Sibley take part in an intensive child sex offenders’ programme, and he was on a waiting list for next year. The board also met with the murdered toddler’s mother and family.

“The central message from the victims was that he was a violent and deceitful paedophile and murderer who had committed sexual and violent crimes against an innocent three-year-old girl.” The board’s decision also noted that Sibley had confessed to having an interest in young girls.

“There is strong evidence supporting the views of the victim that he is a sexual offender and that it was this that preceded the savage murder of an innocent three-year-old and the attempted murder of her mother.” The board noted that supporters of Sibley expressed “a very great frustration” over nothing being done to help their friend.

It also questioned the quality of support and guidance of one of Sibley’s associates. “She asks in an almost unbelievable way, having regard to the brutal murder of the three-year-old, ‘how else could he have covered up what he did?’ We do not attempt to answer such a question.”

The board also noted that a psychological report assesses Sibley as being of a high-risk of violent re-offending and a moderate to low risk of sexual offending. The board said that Sibley would be re-considered for parole after completing the child sex offenders’ course.

According to a New Zealand Herald report from 1997, Sibley suffocated the three-year-old. He then attacked the girl’s 26-year-old mother with a hammer, causing her serious injuries. A neighbour rushed to her help, and police credited the neighbour at the time with saving the woman’s life.

Sibley, then just 18-years-old, was described as “horrendous, callous and cold-blooded” by the sentencing judge.

Police have arrested Matthew Ellery and charged him with the murder of 6-month-old Serenity Jay Scott-Dinnington. Ellery was the boyfriend of Serenity’s mother Chelsea Scott at the time of Serenity’s death in April last year. Serenity’s injuries included severe brain injuries, a broken rib cage and genital injuries.

The boyfriend of a Waikato mother whose 6-month-old daughter died of non-accidental injuries last April will appear in court today charged with the infant’s murder. Waikato detectives yesterday arrested Matthew Ellery and charged him with murdering Serenity Jay Scott-Dinnington at her Ngaruawahia home.

Last night, Serenity’s mother, Chelsea Scott, responded to news of the arrest by changing her relationship status on Facebook from ‘in a relationship’ to ‘single’.

Good to see she’s got her priorities sorted out. 1. Get myself back on the singles market. 2. Justice for my dead child.

She also posted a message saying her “beautiful baby gurl” could rest in peace now.”Rest in peace my angel. Mummy loves u always!”

Detective Senior Sergeant Mark Greene said the accused man would appear in the Hamilton District Court. Inquiries into Serenity’s death took months as detectives pored over evidence and called in overseas forensic pathologists to assist after “areas requiring further investigation” were identified.

“To get to the point where we have sufficient evidence to bring this matter before the courts highlights the hard work and long hours put in by an investigation team who always remained focused on doing what is right for a little girl, whose life ended so tragically,” said Mr Greene.

The arrest was testament to the Ngaruawahia community, who would not tolerate violence to children and had rallied behind police, he said. “It also vindicates the very strong relationship Waikato police have with Child, Youth and Family, whose assistance in this case, from start to finish, has been invaluable.”

Serenity, who had just learned to crawl, was found lying in her room with eyes half-opened at the Havelock Rd home she shared with her mother, uncle Drew Scott and Ellery. She had severe brain injuries, a broken rib cage and genital injuries.

Two days later, on April 28, family members surrounded her at the Starship in Auckland as her life support was switched off. Last night, Ellery’s Whatawhata grandfather – who helped to raise him and told the Herald last year that his grandson was innocent – said he was in shock and could not believe what had happened.

“I probably will go along to court but we don’t know what’s happening ourselves at the moment. We are very shocked,” said Mr Ellery, who has cancer.

Cherie Kurarangi-Sweeney, a former neighbour of Ms Scott, said she was pleased to hear of the arrest. Ms Sweeney, who started Nark (Nation of Advocates for the Rights of Kids) as a result of Serenity’s death, was at her Ngaruawahia home on the day the infant was found injured.

She could hear Ms Scott arguing with her brother Drew, and lots of screaming. “We would like to congratulate Waikato police for securing the evidence to make the arrest. It’s fair to say that we have been waiting for this day for a very long time.”

On January 6, Ms Scott gave birth to a child fathered by Ellery. Child, Youth and Family took the baby less than 48 hours later. Ms Scott’s 6-year-old son, Travis, has been in CYF care since the incident last year.

Hmmm, 21 with three children, oldest being 6! “NO” is obviously not a word she is familiar with.

Ellery appeared with Ms Scott on Campbell Live last year to protest his innocence and to rebut claims that he had anger issues. He said in the interview that he had tried to do CPR on Serenity. “It was too hard and it wasn’t working. Chelsea was a mess and I was shaking.”

Might that have had something to do with you knowing you had just most likely committed murder, or was it the meth?

Ms Scott was asked if she believed that Ellery was not responsible for Serenity’s death. She said: “Yes, I believe him. People haven’t seen the way Matthew is with kids.”

Ms Scott said she knew who the baby’s killer was and pointed the finger elsewhere. On Facebook earlier, she had said the killer was walking around “as if nothing had happened” and she wanted to see justice done. “I know for a fact who killed her.”

Update: Thanks to the commenter ‘X’ below, I have learned that the correct technical term for someone who engages in sexual activity with pubescent minors is Ephebophilia. Pedophilia is defined as engaging in sexual activity with prepubescent minors. No matter what you call it, it’s still a crime, and one deserving a much more punitive sentence than home detention.

Ever hear of a male pedophile being sentenced to home detention? Seems to me what the judge is saying is it’s not really pedophilia when it’s a woman molesting under-aged boys.

Nurse sentenced for sex with teens.

A registered nurse who had sexual liaisons with three teenage boys has been sentenced to a year’s home detention.

Aroha Veronica Webber, 41, was sentenced in the Rotorua District Court today after earlier pleading guilty to six charges of unlawful sexual connection with the 15-year-olds.

Her counsel, Paul Mabey, QC, submitted if they had been a year older no carnal crime would have been committed. She had not sexually groomed the boys.

He outlined how they had gathered at Webber’s home when she was in a fragile state following her marriage breakdown. As a result of this she had “hit the booze” and the offending had occurred, Mr Mabey said.

She had allowed the boys into her home rather than see them wandering the streets.

Webber strenuously denied a claim in a victim impact statement that one of the boys had contracted a sexually transmitted disease from her.

“She is a registered nurse, she knows her own body’s health,” Mr Mabey submitted.

Judge James Weir also discounted the allegation. He noted her offending had been entirely out of character and had occurred when she was “dis-inhibited” by alcohol.

Police have arrested and charged a 16-year-old male with the sexual violation of a 5-year-old girl at a Turangi campground. An angry crowd shouted abuse at the teenager as he was escorted away from the Taupo Youth Court this afternoon.

An angry crowd shouted abuse at the teenager accused of attacking a 5-year-old girl, as he was escorted away from the Taupo Youth Court this afternoon. The 16-year-old youth charged with the sexual violation of a girl at a Turangi campground has not sought bail.

He appeared briefly in court watched on by a gallery filled with family members and media. Judge Jocelyn Munro remanded the youth in custody for two weeks, suppressing any details relating to where the youth has been remanded. Other details were also suppressed.

The youth, whose details are suppressed, is also charged with aggravated wounding and burglary over the incident on December 21. He is next due to appear on January 12. Earlier, the detective heading the investigation into the attack said New Zealand society needed to take a good look at itself.

Detective Inspector Mark Loper spoke at a press conference this afternoon before the accused appeared in court. He said it was concerning that a 16-year-old could commit such a serious offence.

Mr Loper said he was pleased to be able to tell the family, the Turangi community and New Zealand that an arrest had been made. The girl, who was holidaying from Europe with her parents and 3-year-old brother, was attacked on the night of December 21 in a caravan at Club Habitat Holiday Park in the North Island town.

She suffered injuries in the attack, which took place while her parents were only metres away in an amenities block and while her brother slept nearby. The mother had returned to the caravan to find the door locked and saw through a window that her daughter was being attacked. She ran to get her husband but by the time they returned the door was open and the attacker was gone.

In a statement, the girl’s parents said: “We are very relieved at this news (of the arrest) and want to thank the police, particularly those who gave up their precious time when they would usually be with their families. We can’t thank them enough. They were meticulous, thorough and caring. They are a credit to New Zealand.

A five-year-old girl has been seriously injured, in what appears to be a sexually motivated attack at a campground where she was staying with her parents and younger brother.

Staff at a holiday park where a five-year-old girl was seriously injured in a “vicious” attack have been left shaken by the incident. Police said the girl, who was touring the country with her mother, father and brother from Europe, had been staying at Club Habitat in Turangi.

The parents had left their sleeping children in a caravan about 10.40pm yesterday while they went to an amenity block just metres away. As the mother returned she found the caravan door locked and a saw a man inside, police said.

She ran to get her husband and when they got back the door was open, the intruder gone and their daughter lying critically injured on a bed. She suffered serious injuries, mainly to her head and face, and had undergone surgery at Waikato Hospital.

A Club Habitat staff member said they had been instructed not to speak to the media but the incident was shocking, “especially seeing it’s just a few days before Christmas”. Holiday Parks Association chief executive Fergus Brown said staff were shaken.

“They’re very distressed about the whole situation,” he said. “We’re very sad that this has happened and our thoughts are with the family, but it’s very much an isolated incident. But it’s very, very sad, especially at this time of year.”

Mr Brown said he did not think the incident would deter tourists from staying at holiday parks in New Zealand. “Unfortunately crime happens throughout the world and New Zealand has its fair share, but we’re definitely a reasonably safe country to travel in.

“Holiday parks have always been known as safe places to stay at, so we’re very, very concerned about this happening.” Mr Brown said parents should always take care with younger children at holiday parks, many of which were next to beaches, rivers or lakes.

“But I think we are definitely not in the situation where we are in any heightened state of alert for safety at holiday parks. “Holiday parks have always been known as very safe places for families to stay at, and it is the iconic New Zealand holiday, going to stay at the camping ground.”

Detective Inspector Mark Loper, who is leading the investigation, said the timing made the attack worse.

“This is a vicious attack, and the fact that it is on a 5-year-old tourist just days before Christmas makes it all the more appalling. It is vital that anyone who has the smallest piece of information that might help this investigation comes forward as soon as possible,” Mr Loper said.

ESR were carrying out a scene examination and police were interviewing the parents. Bay of Plenty District Commander Superintendent Glenn Dunbier said the family were overwhelmed by the support they had received from emergency services.

A man who twice raped his teenage daughter and committed other sexual offences against two stepdaughters has been jailed for 11 years. The 46-year-old, who has name suppression to protect his victims, pleaded guilty to multiple charges in Gisborne District Court as his trial was about to begin.

Judge Philip Connell said the first rape occurred in December 2009 and the second on New Year’s Day, 2010. Crown prosecutor Steve Manning said the daughter suffered physical harm and emotional damage.

Defence counsel Scott Jefferson said his client had no previous convictions in the adult court and had a difficult upbringing involving “harrowing” sexual abuse.

But his background was “a double-edged sword” – because he had endured abuse, he must have known the effects of his offending on others, Mr Jefferson said.

The complainants were in court for yesterday’s sentencing. Judge Connell said some account had to be taken of the father’s upbringing but “above all else, you knew what you were doing was wrong”.

Stewart Murray Wilson, dubbed the ‘Beast of Blenheim’ is to be released from prison in September 2012, despite being assessed as highly likely to reoffend. During his time in prison Wilson has not made any attempts at rehabilitation, or even acknowledged his crimes. When asked if he would adhere to a condition that he had no contact with children under the age of 16 upon his release, he replied, “I don’t give a stuff about it”.

Wilson has a history of offences against women and children spanning 25 years, including stupefying, beatings, rape, indecent assault, wilfully ill-treating a child, bestiality and attempted rape.

Nice to know that in NZ public safety is more important than the rights of a criminal. Be afraid, be very afraid.

Fears held for Beast of Blenheim’s victims.

The man known as the Beast of Blenheim will be released from prison in September 2012, but he will be subject to release conditions until 2015. In 1996 Stewart Murray Wilson was sentenced to 21 years’ jail for sexual offending against women and girls over a 25-year period.

He will have served his sentence by September 2012, and will be released despite being assessed by the Parole Board as four times more likely to reoffend than the average prisoner.

Wilson would not tell the board at his latest hearing on October 17 where he would go upon his release because that was “his own business”, although he then said he planned to go to an undisclosed location, then whitebait fishing.

He told the board he would have support from a Catholic church cleric and the support of the Prisoners Aid and Rehabilitation Society. However, there are concerns he might return to Blenheim.

Former Blenheim detective Colin MacKay, who headed the 18-month investigation that led to Wilson’s conviction, said he was concerned about him being released. “He certainly has not been rehabilitated. I think he is a concern for everybody, including all his former victims.

“He’s the type of person who I would feel that some of his victims may well be at risk upon his releases, but that’s the law.” The board still believes he has a high risk of reoffending, but Wilson cannot be kept in prison longer than his applicable release date, because of legislation.

Parole Board communications manager Sonja de Friez said Wilson’s case was rare as he was sentenced in 1996 under previous legislation. “His applicable release date given by the judge at the time is September 2012, but his sentence doesn’t finish until December 2015, so he will be released from prison, with certain release conditions set out by the Corrections Department.”

Marlborough Mayor Alistair Sowman would not comment this morning, but deputy mayor Jenny Andrews said it was good to know Wilson would be monitored by police after he was released.

“I think there should be compulsory supervision on him – not every minute supervision, but definitely an eye should be kept on him wherever he chooses to live. What he did was despicable … but I think when someone serves their time, what more can anyone do? The punishment has been served.”

The Parole Board review decision released this month showed the 64-year-old had a high risk of reoffending. When asked if he would adhere to a condition that he had no contact with children under the age of 16 upon his release, he replied, “I don’t give a stuff about it”.

Wilson represented himself and told the board he did not expect them to release him earlier than September 1, 2012. When he first came up for release in December 2008, the board made an order under section 107 to keep him in prison until his applicable release date.

He would have a higher risk of reoffending within two years of being released, the review said. Wilson had shown no interest in addressing his offending or managing the risk of reoffending, the review said. In fact, he had continually denied his offending.

Wilson will appear before the board one final time in March or April next year, before he will be released in September with release conditions. He was convicted on a raft of charges including, indecent assault, rape, stupefying, wilful ill-treatment of a child, and bestiality. He was found guilty on all but two of the 25 charges.
