I rock! I got away with molesting my daughter!

A New Zealand so-called “Celebrity Comedian”, who had pleaded guilty to charges of sexually assaulting his 4-year-old daughter, was discharged without conviction by Judge Philippa Cunningham, because apparently “He’s a talented New Zealander. He makes people laugh”. Personally I’d never heard of this guy before this and I’m certainly not laughing now.

About a dozen protesters gathered outside Auckland District Court today to express their outrage at recent decision where a judge allowed a well known comedian to walk free from sex charges against his 4-year-old daughter.

The court was told that the man went to bed with his partner after returning home drunk from a Christmas work party in December 2009. After he fell asleep, his daughter got into bed with them.

According to the police summary of facts the man laid his daughter on her back, pulled down her pyjama pants and nappy and kissed her. The man’s partner woke up and asked him what he was doing. He replied: “I thought it was you.” He later told police that he remembered nothing of the incident.

Judge Philippa Cunningham discharged the man without conviction after he pleaded guilty to a charge of performing an indecent act. Protest spokeswoman Leonie Morris, of the Coalition for the Safety of Women and Children, said she was outraged by the decision, which sent the wrong message about sexual assault on children.

“One of the horrifying aspects of this case was the so-called ‘reason’ for the assault was that he was under the influence of alcohol and we are sick to the back teeth of this being used as an excuse. It is not an excuse.

“Unfortunately, we still do live in a society that talks about prioritising children but doesn’t do that in practice. This Government spends millions and millions of dollars on rugby but peanuts on protecting children from child sexual assault.”

The court should have directed the man to receive sexual offender treatment to ensure that he doesn’t offend again, she said. “This man has not had treatment. What’s to stop him from sexually assaulting another child in the future?”

The man’s lawyer, Marie Dyhrberg, told the court her client should be allowed to keep his record clean. She said a conviction would make it hard for him to work again as a comedian.

Judge Cunningham said the consequences of a conviction would outweigh the gravity of the offence. She also granted the man permanent name suppression to protect the identity of his daughter. “He’s a talented New Zealander. He makes people laugh. Laughter is an incredible medicine and we all need lots of it.” the judge said.

      I have edited to comply with this stupid NZ law, though it’s ridiculously easy to find out this scumbag’s identity using Google. I wouldn’t want to damage his future employment prospects, God forbid that his actions should have consequences!

      I understand your point about protecting the victims but think this is flawed logic. Not identifying him makes all other male comedians in NZ potential paedophiles, thereby creating more victims.

    Disgusting decision. And how he manages to get name suppression is beyond me – we all know who the offender is and there is no way that the suppression is to protect his daughter. If he was that keen on protecting his child then he shouldn’t have molested her in the first place. He is a revolting example of the human condition and the fact that he has managed to walk away without conviction is plight on our justice system and demonstrates he void of any remorse or moral compass.

    How a grown ‘man’ (I use the term loosely) can claim to mistake his 4 year old child for his partner – a grown woman – is beyond me……does he seriously think that is an excuse? His partner managed to have a child – she is clearly bigger than a 4 year old and all the decent men there is not enough alcohol in the world that would ever make them try & claim such a fallacy.

    This makes me furious. One thing is for sure – his career is over regardless of what the justice system has tried to do.

    The name suppression law protects no one but the abuser – it is a stupid law and all child molesters need to be outed! This is why these mongrels get away with it, because it is hidden. As for that judge, he shud b kicked off the bench. He doesn’t make me laugh knowing what he did to that poor little kid. When is the law going to start protecting our kids instead of the people that hurt them!!!!

    Well children have no chance with a judge with that attitude he should be SACKED hopefully the child will not remember otherwise she would be traumatised for life!!!

    Do people know his name you should shout it too the world id like to know who this is so i can fuckn let people know who cares if the court gives name suppression take matters into our own hands NZ

    Ok as a parent of 4 children – now aged 5 to 21…… and having been intoxicated numerous times throughout life I can say 1000% I could never, would never ever ever make the mistake of mistaking one of my kids for an adult partner. No matter how blind drunk or drugged or anything its just NOT a mistake that one could make. The Judge is a maniac and it shocks me further the Judge is a woman! Woman have great ability to place themselves in others shoes…… problem here…… she’s placed herself in the perpetrators shoes and not in any of the victims shoes. Sickening. She should be struck off. In the future people who get her on cases will go through hell and be sick with worry.
